On the part of the defendant company there was nothing but a formal denial of the allegations.

Though the bare word of an offender can never be taken against the oath of his accuser, yet the magistrate might have employed some labour in cross-examining the watchman, or at least have given the defendant time to send for the other persons who were present at the affray; neither of which he did.

The daring defendant finding, when too late, that this not only kept her out of jail, but her case out of the Supreme Court of the United States, regretfully determined to fight on, and gain the uttermost by a decision in the United States Circuit Court.
