The Federal force making this attack, or advancing promptly to support it, consisted of the corps of Generals Hooker, Mansfield, and Sumner, and numbered, according to General Sumner, forty thousand men, of whom eighteen thousand belonged to General Hooker's corps.

He accordingly, just at sunrise, sent General Mansfield's corps to the aid of General Hooker, and at nine o'clock General Sumner's corps was added, making in all forty thousand men.

His heavy assaulting column had been forced back with great slaughter; General Hooker had been wounded and borne from the field; General Mansfield, while forming his line, had been mortally wounded; and now, at nine o'clock, when the corps of General Sumner arrived, the prospect was depressing.

General Mansfield's corps also had been checked, and now "began to waver and break.

"He (Lord Mansfield) took notice of the King's name having been bandied about in a very improper manner; to which the King assented, saying he had been very much displeased at it, as thinking it unconstitutional to have his name mentioned as a means to sway any man's opinion in any business which was before Parliament; and that all those who approached him knew that to be his sentiment.

Lord Mansfield said he differed from his Majesty in that opinion, for that, though it would be unconstitutional to endeavor by his Majesty's name to carry questions in Parliament, yet where the lawful rights of the King and Parliament were to be asserted and maintained, he thought the making his Majesty's opinion in support of those rights to be known was very fit and becoming."

It may, however, be remarked, as tending to throw some doubt on Mr. Grenville's statement, that Lord Campbell asserts that "Lord Mansfield, without entering into systematic opposition, had been much alienated from the court during Lord Rockingham's first administration.

" Subsequent decisions, however, of two Lord ChancellorsLord Talbot and Lord Hardwickewere not wholly consistent with the doctrine thus laid down by Holt; and the question could not be regarded as finally settled till 1772, when a slave named Somersett was brought over to England from Jamaica by his master, and on his arrival in the Thames claimed his freedom, and under a writ of habeas corpus had his claim allowed by Lord Mansfield.

Moreover, there was actually a law which provided that when the office of Chancellor of the Exchequer is vacant the seals of that office shall be delivered to the Chief-justice; and under this rule, in the latter part of the reign of George II., Chief-justice Lord Mansfield had continued finance-minister for above three months.

Were the talents and acquirements of a Mansfield or a Marshall veiled in a sable skin, they would be excluded from the bench of the humblest court in the American republic.

Lord Mansfield's doctrine, therefore, enlarged and strengthened by American statutes and decisions, had come to be substantially this: Slavery, being contrary to natural right, exists only by virtue of local law; if the master takes his slave for permanent residence into a jurisdiction where slavery is prohibited, the slave thereby acquires a right to his freedom everywhere.
